Right of withdrawal from the contract

Pursuant to the Act of 30 May 2014 on consumer rights, the Ordering Party being a Consumer, who has concluded a distance contract, may withdraw from it without giving any reason within 14 days from the date of receipt of the Goods.

To exercise the right to withdraw from the contract, the Ordering Party must inform the Seller of their decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post to the address: FIXON IRYNA MUKOSII, Mazowiecka 57, 05-077 Warsaw, Poland or by email to the address: mukosiiiryna@wp.pl).

The Ordering Party may use the template withdrawal form, however this is not mandatory.

In order to preserve the deadline for withdrawal from the contract, it is sufficient for the Ordering Party to send information regarding the exercise of their right to withdraw from the contract before the expiry of the withdrawal period.

In the event of withdrawal from this agreement, the Seller shall reimburse the Ordering Party for all payments received from them, including the costs of delivery of the Goods (with the exception of additional costs resulting from the method of delivery chosen by the Ordering Party other than the least expensive ordinary method of delivery offered by the Seller), without delay, and in any case no later than 14 days from the day on which the Seller was informed of the Ordering Party’s decision to exercise the right to withdraw from this agreement.

The Seller shall make the payment refund using the same means of payment as those used by the Ordering Party in the original transaction, unless the Ordering Party has expressly agreed to a different solution; in any case, the Ordering Party shall not incur any fees in connection with this refund.

After the Customer has exercised the right to withdraw from the contract, they are obliged to return the delivered Goods to the Seller. The Goods should be sent back to the Seller’s address (FIXON IRYNA MUKOSII, Mazowiecka 57, 05-077 Warszawa, Poland) without delay, and in any case no later than 14 days from the day on which the Customer informed the Seller of the withdrawal from the Contract. The deadline is met if the Customer sends back the item before the 14-day period has expired.

The Seller may withhold the refund referred to in point 6 above until receipt of the returned Goods or proof of their dispatch, whichever occurs first.

The Ordering Party is only responsible for such reduction in the usefulness of the Goods that results from using them in a manner other than that necessary to determine the nature, characteristics and functioning of the Goods.

The right to withdraw from a Distance Contract does not exclude the Customer’s rights under the warranty for physical defects of the Goods.

The right to withdraw from a Distance Agreement does not apply to Customers who are not Consumers.

Complaints

The Seller is obliged to deliver Goods to the Customer free from defects. The Seller is liable to the Customer under the warranty for physical and legal defects of the purchased Goods on the terms set out in the Civil Code.

How to submit a complaint?

Any complaints, including complaints regarding the Goods and the service of the Online Store, may be submitted:

  • in writing, to the Seller's address (FIXON IRYNA MUKOSII, Mazowiecka 57, 05-077 Warsaw, Poland), including by means of the complaint form referred to below;
  • by email, to the address: mukosiiiryna@wp.pl;
  • using the contact form available on the Online Store Website

Complaint contents

The complaint should contain the data of the person submitting the complaint (first and last name, correspondence address, optionally – e-mail address and contact phone number), an indication of the reason for the complaint and the content of the demand. Where possible, complaints regarding Goods or delivery should also include the order number (provided by the Seller when accepting the order for processing and visible on the Order acceptance confirmation). In the case of complaints regarding the Goods, the original or a copy of the proof of purchase (e.g. invoice or receipt) should be attached to the complaint.

Unless a shorter complaint processing time results from mandatory provisions of law, complaints are processed by the Seller within up to 30 days from their receipt, subject to points 6–7 below.

The Seller shall notify the person lodging the complaint of the manner in which the complaint has been considered by a letter sent to the address provided in the complaint or by e-mail – depending on the method used to submit the complaint.

Complaints regarding physical or legal defects of purchased Goods are handled in accordance with the provisions of the Civil Code on statutory warranty for defects. In the case referred to in Article 561² §1 of the Civil Code, the defective Goods should be delivered at the Seller’s expense to the address: FIXON IRYNA MUKOSII, Mazowiecka 57, 05-077 Warszawa, Poland.

If the Customer who is a Consumer, pursuant to the provisions on statutory warranty for defects, demands the replacement of the Goods or removal of the defect, or submits a statement on price reduction specifying the amount by which the price is to be reduced, and the Seller does not respond to this demand within 14 days, it is deemed that the Seller has acknowledged this demand as justified.

An Ordering Party who is a Consumer and wants to obtain assistance in handling a complaint may contact a municipal or district consumer ombudsman who provides free assistance and advice in the field of consumer interest protection.

Regardless of the rights arising from statutory warranty for defects, the Customer may exercise the rights under the guarantee if it has been granted for the given Goods.

Exercising warranty rights does not affect the Seller's liability under statutory warranty for defects.

The Ordering Party, in order to submit a complaint, may use the complaint submission form. Using this form is voluntary.

How to submit a complaint?

To submit a complaint, follow the steps below:

  5. When submitting a complaint, please return the product along with all its accessories and a copy of the purchase invoice.
